Agreement to Terms

By accessing or using Pinsights ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Pinsights ("we", "us", or "our").

Description of Service

Pinsights is a Pinterest analytics platform that provides users with insights about their Pinterest board and pin performance. The Service includes:

• Board performance analysis and metrics
• Pin-level analytics and categorization
• Data visualization and trend analysis
• Performance recommendations and insights
• Automatic data synchronization with Pinterest via API

Pinterest Integration

Authorization

To use Pinsights, you must authorize our application to access your Pinterest account through Pinterest's OAuth authentication system. By granting this authorization, you:

• Confirm that you have the legal right to authorize access to the Pinterest account
• Understand that Pinsights will access your Pinterest boards, pins, and analytics data
• Agree to comply with Pinterest's Terms of Service and Developer Guidelines
• Acknowledge that you can revoke this authorization at any time

Read-Only Access

Pinsights operates with read-only access to your Pinterest account. We will never:

• Create, edit, or delete your pins
• Create, edit, or delete your boards
• Modify your Pinterest account settings
• Post content on your behalf
• Follow or unfollow accounts

Pinterest Terms Compliance

You agree to use Pinsights in compliance with Pinterest's Terms of Service, Community Guidelines, and Acceptable Use Policy. Any violation of Pinterest's policies may result in termination of your Pinsights account.

Account Registration and Security

Account Requirements

To use Pinsights, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Have a valid Pinterest business or personal account
• Notify us immediately of any unauthorized access to your account

Account Responsibility

You are responsible for all activity that occurs under your account. You agree to:

• Keep your password secure and confidential
• Not share your account with others
• Notify us of any security breaches
• Accept responsibility for all actions taken using your account

One Pinterest Account Per User

Each Pinterest account can only be connected to one Pinsights user account. If you attempt to connect a Pinterest account that is already associated with another Pinsights user, the connection will be rejected.

Acceptable Use Policy

You agree not to use Pinsights to:

• Violate any applicable laws, regulations, or third-party rights
• Engage in any fraudulent, deceptive, or manipulative practices
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers to access the Service
• Interfere with or disrupt the Service or servers
• Transmit viruses, malware, or other harmful code
• Harass, abuse, or harm other users
• Use the Service for any commercial purpose not expressly authorized
• Resell, redistribute, or sublicense access to the Service

Data Ownership and Usage

Your Data

You retain all rights to your Pinterest content and data. By using Pinsights, you grant us a limited license to:

• Access your Pinterest data via Pinterest's API
• Store and process your data to provide analytics insights
• Display your data within the Pinsights dashboard
• Use aggregated, anonymized data for service improvements

Our Data

All analytics, insights, algorithms, and intellectual property created by Pinsights remain our exclusive property. You may not copy, reproduce, or redistribute our proprietary analytics methodologies.

Data Accuracy

While we strive for accuracy, we do not guarantee that analytics data will be 100% accurate or complete. Pinterest API data may have delays, limitations, or discrepancies. You agree to use the Service "as is" and understand that analytics are for informational purposes only.

Service Availability and Modifications

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Pinterest API downtime or rate limits
• Technical issues or server problems
• Force majeure events beyond our control

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

Pinterest API Changes

Pinsights relies on Pinterest's API. Changes to Pinterest's API, policies, or data access may affect the Service. We will make reasonable efforts to adapt to these changes but cannot guarantee all features will remain available.

Subscription and Payments

Free Tier

Pinsights currently offers free access to all users. We reserve the right to introduce paid subscription plans in the future.

Future Paid Plans

If we introduce paid subscription plans:

• Existing free users will receive advance notice
• You may choose to upgrade to a paid plan or continue with limited free features
• Subscription fees will be clearly communicated before purchase
• Payment terms, refund policies, and cancellation procedures will be provided

Intellectual Property

The Service, including all content, features, functionality, software, code, designs, and trademarks, is owned by Pinsights and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or create derivative works of the Service
• Reverse engineer or attempt to extract source code
• Use our trademarks, logos, or branding without permission
• Remove or alter any proprietary notices

Disclaimers and Limitations of Liability

Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

No Guarantee of Results

We do not guarantee that using Pinsights will improve your Pinterest performance, increase traffic, or achieve any specific results. Analytics insights are informational and should not be considered professional advice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PINSIGHTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100 USD, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless Pinsights, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any third-party rights, including Pinterest's terms
• Your use or misuse of the Service
• Any content you provide or actions you take

Termination

Termination by You

You may terminate your account at any time by:

• Deleting your account through account settings
• Contacting support at support@pinsights.app

Upon termination, your data will be deleted according to our Privacy Policy (typically within 30 days).

Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Violation of Pinterest's Terms of Service
• Fraudulent, abusive, or illegal activity
• Non-payment (if applicable to paid plans)
• Any other reason we deem necessary to protect the Service or other users

Effect of Termination

Upon termination:

• Your right to access the Service immediately ceases
• Your data will be deleted according to our Privacy Policy
• Pinterest OAuth access will be revoked
• Sections of these Terms that should survive termination (e.g., indemnification, disclaimers) remain in effect

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Service, you consent to our privacy practices as described in the Privacy Policy.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email if changes are material
• Display an in-app notification when you next log in

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

• Good faith negotiation between the parties
• Binding arbitration if negotiation fails
• Arbitration conducted in accordance with the American Arbitration Association rules

Third-Party Services

Pinsights integrates with third-party services, including:

• Pinterest: Subject to Pinterest's Terms of Service and Privacy Policy
• Supabase: Database and authentication services
• Vercel: Application hosting

We are not responsible for the practices, policies, or actions of these third-party services. Your use of third-party services is governed by their respective terms and policies.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to reflect the parties' intent as closely as possible.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pinsights regarding the Service and supersede all prior agreements, understandings, and communications.
